1 Scope

These usage terms and conditions refer to use of the "Learning Platform of DACHSER SE."

2 The "Learning Platform of DACHSER SE"

1. This E-learning system is a product of DACHSER SE.
2. DACHSER SE offers information, knowledge, and E-trainings with corresponding access mechanisms for employees of DACHSER SE on the learning platform. Access and use of the documents are subject to the following usage terms and conditions. Access and use are granted to you only if you acknowledge these usage terms and conditions.

3 Copyrights

You acknowledge that the information, texts, software, images, videos, graphics, sound, and other materials on the Learning Platform of DACHSER SE are protected by copyrights, trademarks, or patent rights and that the copyrights and exploitation rights belong solely to DACHSER SE or their licensors.

4 Use of the information and materials

1. The right to access and use granted to you on the Learning Platform is not transferable and is yours alone. You are entitled to use (e.g. read, download, print) the materials to which you have access on the Learning Platform of DACHSER SE for the provided extent. This right exists solely for your personal and non-commercial use.
2. You agree not to reproduce, use, sell, transfer, publish, or otherwise make available the materials for other purposes. You may not use the materials in postings in newsgroups, mailing lists, electronic bulletin boards, etc., unless corresponding permission is evident from the materials or from the Learning Platform in the particular case.

5 Location and modification of these usage terms and conditions

1. The text of these terms and conditions can be viewed online under "Usage Terms and Conditions" on the system homepages.
2. DACHSER SE is entitled to modify any part of these terms and conditions at any time. Changes will take effect as soon as DACHSER SE has published them online. By continuing to use the Learning Platform, you agree to the amended usage terms and conditions and are bound by the provisions of the amended terms and conditions. You can refuse to accept the changes only by terminating use of the Learning Platform DACHSER SE.

6 Registration (logging on) and access code

1. By using the Learning Platform of DACHSER SE under these terms and conditions, you promise that

• You will not communicate your access code and password to anyone.

2. You acknowledge that

• You are responsible for any use of the Learning Platform product of DACHSER SE that occurs under your access code and password,
• You must ensure that your access code and password are protected from unauthorized use,
• You are obligated to notify DACHSER SE immediately if you notice or suspect any misuse of your access data.

7 Data privacy

Personal data will be stored only to enable the user to access the content.
Data concerning user behavior on the Learning Platform is recorded by the system and can be viewed by administrators or authors. Users themselves can specify data beyond the publication of the name and username in the personal profile.
Users furthermore agree that data may be stored beyond the period of use in order to e.g. optimize the training product. Naturally, we are in compliance with data privacy laws while carrying out our E-learning activities.

8 Users' duties

Users may not make any defamatory or illegal comments or statements in their posts (forums, chats, hyperlinked sites and uploaded files, etc.). Users are required to the best of their knowledge and conscience to refrain from taking any actions or making any data entries on the Learning Platform that could disrupt overall operation.

9 End of the Learning Platform usage authorization

DACHSER SE can entirely or partially suspend access to the learning platform content or terminate your usage authorization (access with access code and password) if the Learning Platform content is used under your access code and password, whether by you or a third party, in a manner that in the opinion of DACHSER SE constitutes a violation of these terms and conditions or can otherwise harm DACHSER SE.

10 Warranty and product liability

You expressly agree that use of the Learning Platform and the Learning Platform content will be at your own risk. DACHSER SE makes no guarantee that the program functions will satisfy the requirements of the users or will cooperate in the selection made by them. The provider, manufacturers, or developers will be liable for damages that occur due to use of the Learning Platform or its contents.
